By accessing or using Gestalty's platform, website, mobile applications, or services (collectively, the "Platform"), you confirm that you are at least 16 years old, have the legal capacity to enter into this agreement, and agree to be bound by these Terms and our Privacy Policy. If you are using Gestalty on behalf of an organization, you represent that you have authority to bind that organization.

• Account Creation: You must provide accurate, current, and complete information during registration, including your name, email address, phone number, and exam goals.

• Account Security: You are responsible for maintaining the confidentiality of your login credentials, all activities under your account, and immediately notifying us of any unauthorized access or security breach.

• Account Restrictions: Each account is for individual use only. You may not share your account credentials, transfer your account to another person, or create multiple accounts to abuse our services or pricing.

• Plan Selection: Gestalty offers various subscription plans (Foundation, Professional, etc.) with different features and pricing. Current pricing and plan details are available on our website.

• Payment Terms: Subscriptions are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge your payment method for the selected plan and any applicable taxes (GST).

• Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You will be charged at the then-current rates unless otherwise specified.

• Refund Policy: We offer a 7-day money-back guarantee for first-time subscribers. Refund requests must be submitted to support@gestalty.com. No refunds are provided for renewals or after the initial 7-day period.

• Price Changes: We may modify subscription prices with at least 30 days' notice. Existing subscribers will be notified via email and can cancel before changes take effect.

You may use Gestalty for personal exam preparation purposes, including accessing study tools, tracking progress, receiving AI-powered insights, and participating in mentorship sessions (if applicable to your plan).

Prohibited Activities — You may not:

• Use the Platform for any illegal or unauthorized purpose

• Share, sell, or distribute study materials or content without permission

• Attempt to reverse engineer, decompile, or hack the Platform

• Upload malicious code, viruses, or harmful content

• Scrape, crawl, or automatically extract data from the Platform

• Impersonate others or provide false information

• Interfere with the proper functioning of the Platform

• Use the Platform to harass, abuse, or harm others

• Our Content: All content, features, and functionality of the Platform, including text, graphics, logos, software, algorithms, AI models, and study materials, are owned by Gestalty Technologies Pvt. Ltd. and protected by copyright, trademark, and other intellectual property laws.

• Your Content: You retain ownership of any content you create or upload. By using the Platform, you grant us a limited license to use, process, and analyze your data to provide and improve our services.

• License to Use: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial exam preparation purposes.

• Data Processing: We use AI algorithms to analyze your study patterns, performance data, and learning behavior to provide personalized recommendations, progress predictions, and cognitive insights.

• No Guarantees: While we strive for accuracy, we do not guarantee specific exam results, admission outcomes, or learning improvements. Your success depends on multiple factors beyond our Platform.

• Third-Party Content: Some study resources may come from third-party sources. We are not responsible for the accuracy, completeness, or quality of third-party content.

• Uptime: We strive for 99.9% uptime but do not guarantee uninterrupted access. The Platform may be temporarily unavailable due to maintenance, updates, or technical issues.

• Modifications: We reserve the right to modify, suspend, or discontinue any feature or service at any time, with reasonable notice when possible. We may also update these Terms and will notify you of material changes.

• By You: You may cancel your subscription or delete your account at any time through account settings or by contacting support@gestalty.com.

• By Us: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, abuse our services, or pose a security risk. Termination does not entitle you to a refund except as required by law.

• Effect of Termination: Upon termination, your access to the Platform will cease, and we may delete your data after a reasonable retention period, except where legally required to retain information.

• Service "As Is": The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose.

• Educational Tool: Gestalty is a study aid to be used alongside official materials, coaching, and self-preparation. We do not replace formal education or guarantee exam success.

• Limitation of Liability: Gestalty and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

• Maximum Liability: Our total liability for any claims shall not exceed the amount you paid to Gestalty in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless Gestalty and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your violation of these Terms, misuse of the Platform, or infringement of any rights of others.

• Governing Law: These Terms are governed by the laws of India, without regard to conflict of law principles.

• Jurisdiction: Any disputes shall be subject to the exclusive jurisdiction of courts in Bangalore, Karnataka, India.

• Informal Resolution: Before filing any legal claim, you agree to contact us at legal@gestalty.com to attempt to resolve the dispute informally.

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gestalty.

• Severability: If any provision is found unenforceable, the remaining provisions will continue in full effect.

• No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.

• Assignment: You may not transfer or assign your rights under these Terms. We may assign our rights to any affiliate or successor.
